Welcome to the FDI Moot
Asia-Pacific Regional Rounds

Since 2013, FDI Moot Asia-Pacific Regional Rounds has taken place in Seoul, Republic of Korea. This is the fourth FDI Moot Asia-Pacific Regional Rounds and we are pleased to host the competition again in Seoul. In cooperation with the Ministry of Justice of the Republic of Korea (MOJ), Seoul International Dispute Resolution Center (SIDRC),the Korean Commercial Arbitration Board(KCAB) co-organizes the competition with the Center for International Legal Studies (CILS)and Seoul National University School of Law (SNU Law) this year, and wegreatly appreciate the efforts and support of everyone involved in making this competition happen. Being the 4th Asia-Pacific Regional Rounds, we are excited to have a lot of teams representing countries in the Asia-Pacific region.

Students, coaches, and arbitration practitioners from the region have been invited to participate in this educational exercise. We have planned social activities in hopes that all invitees are able to build or maintain transnational relationships with professionals in the field.

We would like to appreciate k all participants, coaches, and judges for their time and dedication to the FDI Moot. Our appreciationand recognition should also go to all the sponsors and organizers, especially to the Ministry of Justice, Ministry of Energy, Industry and Trade of the Republic of Korea (MOTIE) and the CILS. Combining the efforts of various parties, we are pleased to welcome you all to the 4th FDI Moot Asia-Pacific Regional Rounds. We hope you enjoy the competition and your stay in Seoul.

Introducing the Moot

The FDI Moot

The Moot helps future lawyers gain a practical understanding of the issues that arise out of obligations between host States and foreign investors. Bringing together academics and practitioners, and future lawyers, a forum is created not only to discover emerging talents, but new developments in the field are discussed. Each year, theFDI Moot Problem involves issues related to investment planning, a state's power to introduce new measures to protect public health, its BIT obligations, and the damages recoverable by an investor.

The Asia-Pacific Regional Rounds

The Korean Commercial Arbitration Board (KCAB) and the Center for International Legal Studies (CILS) have been organizing the FDI Moot Asia-Pacific Regional Rounds to be held in Seoul in mid-August every year since 2013 with the support from the Ministry of Justice of the Republic of Korea, Ministry of Trade, Industry and Energy of the Republic of Korea and the Seoul International Dispute Resolution Center (SIDRC). As Seoul has become an active venue forinternational arbitration, the participants will compete in a dynamic city and develop an international network with academics and practitioners in the arbitration field.

Procedure

The FDI Moot participants submit written memorials for the claimant and respondent, and give oral arguments. In doing so, these future lawyers are able to develop their ability to research, draft, and advocate. To prepare, teams are expected to analyze the facts and evidence given, research relevant legal texts, craft legal arguments, draft memoranda for claimant and respondent, and advocate their relevant position before an international tribunals of experts.
